General Purchase Conditions

The website www.apilaediciones.com is configured as a virtual store where the customer can purchase the desired products directly. However, APILA-Association for the Promotion of Aragonese Illustrators (hereinafter, the SELLER) offers other means to contact the company, either by phone or email.

The online purchase and its process through this website will be regulated by these conditions that bind both the page owner and the buyer (Client), granting them a series of rights and obligations, from the moment in which The latter places and accepts an order through this page. They are mandatory and knowledgeable by both parties, so their acceptance is essential in order to formalize an order. Therefore, the Client must carefully read these conditions.

1. Object of the Contract

By this contract the CLIENT (user who accesses the virtual store, voluntarily enters his personal data in the purchase form and accepts the purchase conditions) purchases one or more products of which the SELLER offers on the website www.apilaediciones .com.

As a customer, you declare that you are of legal age and have sufficient legal capacity to be bound by these purchasing conditions when contracting with the SELLER. Notwithstanding the foregoing, you agree, expressly and without exception, that access and use of the website’s virtual store takes place under your sole and exclusive responsibility.

2. Placing the order and delivery times

The CLIENT will make the order through the website www.apilaediciones.com filling in the information that will be requested through the corresponding purchase form. The SELLER agrees to deliver the requested products within the following deadlines:

a) In the case of orders for an amount greater than 50 euros, the approximate delivery time will be 48 hours (2 business days).
b) In the case of orders for less than 50 euros, the approximate delivery time will be 4-5 business days, for shipments to the Peninsula, the Balearic Islands, Ceuta and Melilla, or 8 business days for shipments to the Canary Islands.

Delays in delivery attributable to the CLIENT. The delays derived from an incorrect consignment of the delivery data or the lack of payment will be attributable to the CLIENT.

3. Payment methods

Payment can be made by credit card, through the payment gateways enabled in the virtual store, or through the PAYPAL platform.

4. Security

When the client chooses payment by credit card, he will automatically access a secure payment gateway managed by the entities previously indicated, which will be responsible for carrying out the appropriate procedures with the client in order to check the validity of the operation. In case of choosing the payment through PAYPAL, the client will automatically access the Paypal page where the payment can be made by credit card or with a balance accumulated in the user’s account, being PAYPAL the one that manages the entire operation . In no case does the SELLER save or maintain the bank or card data of the clients.

5. Returns

5.1. The SELLER establishes, in accordance with current legislation, a withdrawal period of 7 business days from the date of receipt. In the case of occurring within this period, the customer will bear the direct costs of the return.

5.2. The SELLER will not accept returns:
a) if the product is not presented in perfect condition;
b) if the product packaging is not the original and it is not in perfect condition. The original packaging must be protected so that it is received in perfect condition.

5.3. Return procedure: During the first 7 days the CUSTOMER can return the product by indicating the reason, the transport tracking number and the transport shipping date by email to apila@apilaediciones.com or by phone 617 22 78 43.

5.4. In the case of a defective product, contact our customer service department to resolve the specific case by e-mail apila@apilaediciones.com or by phone 617 22 78 43.

6. Confidentiality, privacy and protection of personal data

In accordance with the provisions of Organic Law 15/1999, on the Protection of Personal Data (LOPD) and its implementing regulations, the SELLER, in compliance with the provisions of art. 5 and 6 of the LOPD, informs the CLIENT that the personal data they provide will be incorporated into an automated file that is duly registered with the Spanish Agency for Data Protection, whose owner and responsible is the SELLER. Likewise, it informs that the collection and processing of data is intended to manage the customer’s order and the legal and contractual relationships that derive from it. THE CLIENT may, at any time, exercise their rights of access, rectification, cancellation and opposition to the processing of personal data, in the manner provided by law. For this, it will be enough to send a communication of said intention to the email: apila@apilaediciones.com.

7. Applicable law and jurisdiction

For the resolution of all controversies or issues related to this contract, Spanish law will apply, to which the parties expressly submit, being competent for the resolution of all disputes arising or related to its use, the Courts and Tribunals of Saragossa.
